SECTION 3, INTERNATIONAL SHIPPING

3.1 We ship worldwide. International delivery times depend on the country of destination and on customs processing.

3.2 Customs delays and customs inspections in the country of destination are beyond our control. Where charges are imposed by the authorities of the country of destination, the party who bears them follows the shipping terms stated for your order. Where those terms are the terms described in Section 13, that Section applies to the shipment. Where they are not, any such charge is the responsibility of the recipient.

3.3 A customs delay or a customs inspection is not a lack of conformity of the goods. It does not affect the rights you have under Section 7, Section 17, and Section 18.

SECTION 4, GENERAL PROVISIONS

4.1 We reserve the right to refuse service to anyone, for any reason, at any time.

4.2 You understand that your content, excluding credit card information, may be transferred unencrypted and may involve: a. transmissions over various networks; and b. changes to conform and adapt to the technical requirements of connecting networks or devices.

4.3 You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, the use of the Service, or access to the Service without our express written permission.

SECTION 5, ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

5.1 We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate, more complete, or more timely sources of information.

5.2 This site may contain historical information. Historical information is not necessarily current and is provided for reference only.

5.3 We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site.

5.4 The foregoing does not affect the information we are required to provide to you before you are bound by the contract. That information is binding on us. See Section 8 and Section 13.

SECTION 6, MODIFICATIONS TO THE SERVICE AND PRICES

6.1 We reserve the right to modify or discontinue the Service, or any part or content of it, at any time.

6.2 Prices for our products are subject to change. A change of price after the contract has been concluded does not affect orders already placed.

6.3 We are not liable to you or to any third party for any modification, suspension, or discontinuation of the Service. This exclusion does not apply to obligations under a contract that has already been concluded.

SECTION 7, PRODUCTS

7.1 Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return in accordance with Section 18.

7.2 We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that the display of any colour on your screen is accurate.

7.3 We reserve the right, but are not obliged, to limit the sale of our products to any person, geographic region, or jurisdiction, to limit the quantities of any product we offer, and to discontinue any product at any time.

7.4 Our products are strength and streetlifting equipment intended to bear load in use. The maximum rated load is stated on the product page. Use of a product beyond its rated load, or use of a damaged product, may cause serious injury. You are responsible for inspecting a product before each use and for discontinuing use where it shows wear or damage.

7.5 Where you are a consumer resident in a member state of the European Union, you have a legal guarantee of conformity. We are liable for any lack of conformity which exists at the time of delivery and becomes apparent within two years of that time, and for a longer period where the law of your country of residence provides for one.

SECTION 8, PRICES AND DELIVERY CHARGES

8.1 Prices are stated on our site in the currency indicated there. Delivery charges, where they apply, are stated separately before you complete your order.

8.2 Where an order is placed on the basis of a manifest error in the price, we will inform you without delay and you have the right to withdraw from the contract at no cost with a full refund within 14 days.

SECTION 9, ACCURACY OF BILLING AND ACCOUNT INFORMATION

9.1 We reserve the right to refuse any order you place with us. We may, at our discretion, limit or cancel quantities purchased per person, per household, or per order.

9.2 These restrictions may include orders placed under the same customer account or the same payment card, or orders that use the same billing or shipping address. Where we change or cancel an order, we will notify you at the email address or telephone number given at the time of the order. Any payment already received is refunded within 14 days.

9.3 You agree to provide current, complete, and accurate purchase and account information for all purchases made in our store, so that we can complete your transaction and contact you where necessary.

SECTION 10, OPTIONAL TOOLS

10.1 We may give you access to third party tools over which we neither monitor nor have any control.

10.2 You acknowledge and agree that we provide access to such tools as they are and as available, without any warranty, representation, or condition of any kind and without any endorsement.

10.3 Any use by you of optional tools offered through the site is at your own risk. You should ensure that you are familiar with and approve of the terms on which those tools are provided by the relevant third party.

10.4 We may offer new services or features through the website in the future. Such new features and services are also subject to these Terms and Conditions.

SECTION 11, THIRD PARTY LINKS

11.1 Certain content, products, and services available through our Service may include material from third parties.

11.2 Third party links on this site may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy.

11.3 We are not liable for any harm or damages related to the purchase or use of goods, services, or content of third party websites. Complaints or questions regarding third party products should be directed to that third party. This Section does not apply to products you buy from us.

SECTION 12, USER COMMENTS AND OTHER SUBMISSIONS

12.1 If you send us, at our request or on your own initiative, creative ideas, suggestions, proposals, plans, or other materials, together referred to as comments, you agree that we may at any time edit, copy, publish, distribute, translate, and otherwise use those comments in any medium. We are under no obligation: a. to keep any comments confidential; b. to pay compensation for any comments; or c. to respond to any comments.

12.2 We may, but are not obliged to, monitor, edit, or remove content that we consider in our sole discretion to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that infringes the intellectual property rights of any party or these Terms and Conditions.

12.3 You agree that your comments will not violate any right of a third party, including copyright, trade mark, privacy, or personality rights. You may not use a false email address, pretend to be someone other than yourself, or mislead us or third parties as to the origin of any comments.

12.4 We accept no liability for comments posted by you or by any third party.

SECTION 13, IMPORTATION AND SHIPPING ON A DDP BASIS

13.1 Shipping environment. You acknowledge that the goods ordered through this website are shipped to you directly from outside your country by a fulfilment agent engaged by us.

13.2 Shipping terms. Whether an order is shipped on a Delivered Duty Paid basis, DDP, as described in Incoterms 2020, follows the shipping terms stated for that order. Where an order is shipped on that basis, we, or the fulfilment agent engaged by us, bear the costs, formalities, and risks of importation, up to and including delivery of the goods to the address you have given. Where an order is not shipped on that basis, 3.2 applies instead.

13.3 More than one consignment per order. An order may be delivered in more than one consignment. The commitment in 13.2 applies to each consignment separately, regardless of the value of that consignment and regardless of the number of consignments in which the order is shipped.

13.4 Delay, seizure and non-delivery at importation. Where the goods are shipped on the basis described in 13.2, delay, seizure, or non-delivery arising from the import formalities is at our risk. Where a consignment is not delivered as a result, you may choose between a replacement delivery and termination of the contract with a full refund within 14 days. We cannot rely on an act or omission of our supplier, our fulfilment agent, or a carrier in that respect.

13.5 Provision of your data. In order to carry out the import formalities and the delivery, we provide your name, address, and order details to our fulfilment agent, the carrier, and the customs authorities. We provide no data other than what is necessary for that purpose.

13.6 Passing of risk. The risk of loss of or damage to the goods passes to you when you, or a third party indicated by you other than the carrier, acquire physical possession of the goods.

SECTION 14, ERRORS AND OMISSIONS

14.1 There may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, offers, delivery charges, delivery times, and availability.

14.2 We reserve the right to correct errors, inaccuracies, and omissions and to change information. Where an order has been placed on the basis of a manifest error in the price, Section 8.2 applies.

14.3 We undertake no obligation to update or clarify information in the Service, except where required by law.

SECTION 15, PROHIBITED USES

15.1 In addition to the other prohibitions in these Terms, you are prohibited from using the site or its content: a. for any unlawful purpose; b. to solicit others to perform unlawful acts; c. to violate any international, national, provincial, or local law or regulation; d. to infringe our intellectual property rights or those of others; e. to harass, abuse, insult, harm, defame, disparage, or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; f. to submit false or misleading information; g. to upload or transmit viruses or other malicious code; h. to collect the personal information of others; i. to spam, phish, pharm, impersonate, spider, crawl, or scrape; j. for any obscene or immoral purpose; or k. to interfere with or circumvent the security features of the Service or any related website.

15.2 We reserve the right to terminate your use of the Service for breach of these prohibitions.

SECTION 16, WARRANTIES AND LIMITATION OF LIABILITY

16.1 We do not warrant that your use of our website will be uninterrupted, timely, secure, or error free.

16.2 We reserve the right to remove the website for an indefinite period or to terminate the Service at any time. Contracts already concluded will be performed in full.

16.3 Use of the website is at your own risk. The website is provided as it is and as available. This Section relates to the use of the website and not to the products you buy from us.

16.4 Our liability for indirect loss, including loss of profit, loss of turnover, and lost savings, is excluded. Our liability for direct loss is limited to the amount of the order concerned, unless the loss is the result of intent or gross negligence, or unless the law provides for a wider liability.

16.5 Nothing in these Terms and Conditions limits or excludes the rights you have as a consumer under mandatory law, including your rights in respect of the conformity of the goods, your right of withdrawal, and liability for defective products. Where this Section conflicts with mandatory consumer law, the mandatory law prevails. Nothing in this Section limits our liability for death or personal injury caused by our negligence, or for a defective product, where that liability cannot be limited by law.

SECTION 17, DELIVERY AND DELIVERY PERIOD

17.1 The products are shipped to you directly from abroad. The expected delivery time is 4 to 14 working days after shipping confirmation, and in any event we deliver without undue delay and not later than 30 days from the conclusion of the contract, unless a different period is stated with the product and agreed by you. This is the period referred to in Article 18(1) of Directive 2011/83/EU.

17.2 If delivery is delayed, we will inform you as soon as possible. Where we fail to deliver within the period in 17.1, you may call on us to deliver within an additional period appropriate to the circumstances. If we fail to deliver within that additional period, you are entitled to terminate the contract and we will refund all sums paid within 14 days. Where the period in 17.1 is essential to you and you have told us so, or where the period is essential in the circumstances, you may terminate immediately.

17.3 Delay connected with the importation of the goods is at our risk under Section 13.4 and does not extend the period in 17.1.

SECTION 18, RIGHT OF WITHDRAWAL AND RETURNS

18.1 You have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason, in accordance with Article 9(1) of Directive 2011/83/EU. You may use the model withdrawal form included as Annex I to these Terms and Conditions, but you are not obliged to. An email or any other unambiguous statement to our customer service is sufficient.

18.2 After notifying us of your withdrawal you send the goods back within 14 days, in accordance with Article 14(1) of Directive 2011/83/EU. The return address is stated in Section 2 and is also provided to you with the confirmation of your withdrawal.

18.3 During the withdrawal period you handle the goods and their packaging with care. You may unpack and use the goods only to the extent necessary to establish their nature, characteristics, and functioning, as you would be able to in a physical shop. You are liable for any diminished value resulting from handling beyond that.

18.4 The direct cost of returning the goods is borne by you. The amount of that cost is stated on the website before you place your order. Where that statement has not been given, the return cost is borne by us.

18.5 After we receive the returned goods, or after you have supplied evidence that the goods have been sent back, we refund all payments received from you within 14 days, in accordance with Article 13(1) of Directive 2011/83/EU. The refund covers everything you paid us for the order, including the standard delivery charge we charged you. The refund is made using the same means of payment you used, unless you expressly agree otherwise. No fee is charged for the refund.

18.6 The right of withdrawal does not apply to: a. sealed goods which are not suitable for return for reasons of health protection or hygiene and which were unsealed after delivery, in accordance with Article 16(e) of Directive 2011/83/EU; and b. goods made to your specifications or clearly personalised, in accordance with Article 16(c) of that Directive.

Where an exception applies, this is stated with the product before you place your order. Where that statement is absent, the right of withdrawal applies in full.

SECTION 19, COMPLAINTS

19.1 Complaints about the performance of the contract may be submitted to the customer service email address in Section 2. Complaints should be submitted within a reasonable time after you have identified the defect, described in full and clearly.

19.2 We answer complaints within 14 days of receipt. Where a complaint requires a longer processing time, you receive an acknowledgement within 14 days with an indication of when you can expect a substantive answer.

19.3 Where we do not reach a solution together, you may bring the dispute before the competent court in accordance with Section 25.

SECTION 20, INDEMNIFICATION

You agree to indemnify us and our parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable legal fees, made by a third party as a result of your breach of these Terms and Conditions, of any law, or of the rights of a third party. This indemnity does not extend to claims connected with the importation of the goods or with a failure on our part or on the part of a supplier, fulfilment agent, or carrier engaged by us.

SECTION 21, SEVERABILITY

Where any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision remains enforceable to the fullest extent permitted by applicable law and the unenforceable part is deemed severed from these Terms. This does not affect the validity and enforceability of the remaining provisions.

SECTION 22, TERMINATION

22.1 Obligations and liabilities of the parties incurred before the date of termination survive termination.

22.2 These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our services, or by ceasing to use our site.

22.3 If you fail to comply with any provision of these Terms and Conditions, we may terminate this agreement. You remain liable for all amounts due up to the date of termination.

SECTION 23, ENTIRE AGREEMENT

23.1 Our failure to exercise or enforce any right or provision of these Terms and Conditions does not constitute a waiver of that right or provision.

23.2 These Terms and Conditions and any policies posted by us on this site constitute the entire agreement between you and us and supersede all prior agreements, communications, and proposals, whether oral or written, including any earlier version of these Terms and Conditions.

SECTION 24, PRECEDENCE

24.1 Where there is a conflict between these Terms and Conditions and a specific agreement between you and us, the provisions of that specific agreement prevail, provided they are not less favourable to you than these Terms and Conditions and not less favourable than mandatory law.

SECTION 25, GOVERNING LAW AND JURISDICTION

25.1 These Terms and Conditions and any separate agreement under which we provide you services are governed by the laws of the State of Wyoming, United States of America.

25.2 Where you are a consumer habitually resident in a member state of the European Union, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, in accordance with Article 6(2) of Regulation (EC) No 593/2008. Where you are a consumer habitually resident in the United Kingdom, the equivalent protection under the law applicable there is likewise unaffected.

25.3 Nothing in this Section affects your right to bring proceedings before the courts of your country of habitual residence where the applicable rules of jurisdiction give you that right.

SECTION 26, CHANGES TO THESE TERMS

26.1 You can review the most current version of these Terms and Conditions at any time on this page.

26.2 We reserve the right to update, change, or replace these Terms and Conditions by posting updates on our website. The version that applies to a concluded contract is the version in force at the time of your order.

26.3 Your continued use of our website after a change is posted constitutes acceptance of that change for future orders.
